DECISION ON COSTS AND INTEREST

1. I have now read and considered the parties’ written submissions and the correspondence relating to the above outstanding issues.I have been asked to make further directions before resolving these issues but I do not consider it necessary to do so.

2. Interest on the damages in paragraphs 37(i), (ii) and (iii) of the judgment shall run from 1 December 2010.

3. The defendant shall pay 75% of the plaintiff’s costs to be taxed if not agreed.
