COURT: The defendant, a 37-year-old Guinean national, pleaded guilty to an offence of trafficking in 366.89 grammes of heroin beforea magistrate at Kowloon City Magistracy and was committed to this court for sentence, pursuant to the provisions of section 81B of the Magistrates Ordinance.
The facts of the case were quite straightforward. The defendant brought the drugs into Hong Kong on a flight from Thailand. They were concealed inside his body. He was later arrested at Chungking Mansions in Kowloon.
I take a starting point of sentence of 14 years’ imprisonment. The only mitigation of substance available to the defendantis his plea of guilty. His family circumstances are not such as to be taken into account so far as sentence is concerned.
On that basis, the starting point of sentence is reduced to a sentence of 9 years 4 months’ imprisonment.
